Pursuant to Article 391 Paragraph 1 of the Act on Ownership and Other Real Rights (The Official Gazette of the Republic of Croatia no. 91/96., 68/98., 137/99., 22/00., 73/00., 114/01., 79/06., 141/06., 146/08., 38/09. and 153/09.) and Decisions on the sale of property owned by the Međimurje County (the southern part of the former military complex in Čakovec) brought by the Međimurje County Assembly on 11th December 2009, the Prefect of the County of Međimurje announces:
INVITATION TO BID
FOR SALE OF PROPERTY OWNED BY THE COUNTY OF MEÐIMURJE
I. Subject of the Invitation
Subject of the Invitation is a sale of property registered at the Municipal Court in Čakovec, land register sheet no. 7374, land registry plot no. 1134/2/2, by nature seven areas of built – up land and a courtyard situated on bana Josipa Jelačića Street, overall surface area of 25 002 m2. The property comprises a land of overall surface area of 126 m2, a land of overall surface area of 896 m2, a land of overall surface area of 275 m2, a land of overall surface area of 26 m2, a land of overall surface area of 188 m2, a land of overall surface area of 39 m2, a land of overall surface area of 46 m2 and a courtyard of 23 406 m2.
The property is zoned as mixed – use, predominantly business area – zoning code M2, according to the Urban Master Plan of the City of Čakovec (“The Official Gazette of the City of Čakovec” no. 5/05, 1/09). According to the Urban Master Plan of the City of Čakovec, among other mentioned in Article 11, Paragraph 3, it is stipulated that on the property marked as the M2 subzone, besides all other conditions being fulfilled, business complexes may be constructed – service industry and/or commercial facilities (shopping malls, business centres, administrative centres and similar), catering – tourism facilities, service and accommodation facilities, communal services facilities (apart from waste disposal) and other facilities stipulated in Article 13.
A detailed zoning plan of the respective property is currently being prepared.
II. Conditions for the property purchase
Participation in bidding is open to all citizens of the Republic of Croatia who have reached legal age and to legal persons registered in the Republic of Croatia. Foreign persons (natural and legal) may participate in the bidding provided they comply with all legal conditions for acquiring right of ownership in the Republic of Croatia.
III. The initial bidding price and a bid security
The initial bidding price is 70 € per 1/m2 payable in kuna counter value according to the middle exchange rate of the Croatian National Bank on the date of payment, i.e., 1.750.140,00 € in total payable in kuna counter value according to the middle exchange rate of the Croatian National Bank on the date of payment.
Bidders are required to furnish a bid security in the amount of 17.500,00 € in kuna counter value according to the middle exchange rate of the Croatian National Bank on the date of payment to the Međimurje County business account no: 2392007-1800020004 in Međimurska bank d.d. Čakovec, V. Morandinija 37, payment code no. 21 7307 – MB (for legal persons) or 22 7307 – Pers.Id.No. (for natural persons), payment purpose: „ jamčevina za kupnju nekretnine“ (for foreign bidders SWIFT: MBCKHR2X, IBAN: HR8023920071000000013).Bid securities furnished by bidders who have not been selected shall be released within 8 days as of the day of the selection of the most successful bidder, in its nominal amount without interest, while the amount of bid security shall be calculated towards purchase price as far as the successful bidder is concerned.
The bidder, who refrains from the purchase upon being selected as the most successful bidder, or the bidder who fails to pay the whole sum of the purchase price within scheduled date, shall forfeit the right to the bid security retrieval.
IV. Contents and enclosures to the bid
1. Name, surname and address of the bidder (if natural person), i.e. company name and company registered location (if legal person);
2. Copy of an identity card, certificate of registration at the company or crafts or any other appropriate register
3. The amount of bidding price in kn and EUR (in numbers and in words)
4. Proof of the bid security payment
5. Bidder’s account number with all necessary data and the name of a bank to which the bid security shall be returned
V. Deadline and address for submission of the bid
The bidder shall submit the written bid along with the enclosures in a sealed envelope to the following address: Međimurska županija, Ruđera Boškovića 2, 40 000 Čakovec specifying the bid reference: “Ponuda za kupnju nekretnine – južni dio vojarne u Čakovcu”
Bids must be received by the deadline, 5th February 2010 at 12.00 hrs, no matter what type of delivery is chosen. Late and incomplete bids will automatically be rejected.
VI. Selection of the most successful bid, contract signing and transfer of ownership
Selection of the most successful bidder shall be made by the Međimurje County Prefect within 3 days as of the expiration of the deadline for submission of bids.
The selected bidder must sign the purchase contract within 8 days as of receiving the notice on sale of the property. Within further 30 days of signing the contract the selected bidder must pay the whole amount of purchase. Otherwise, it will be considered the bidder is refraining from the purchase.
Permission to register the property clause (clausula intabulandi) shall be given to the buyer after he/she pays the whole purchase amount. Payments within set time limits shall be an important part of the contract.
Property transfer tax and other costs related to transfer of ownership shall be borne by the buyer.
Upon request of the selected bidder, the County of Međimurje will allow the buyer’s bank to register a lien on the property from Paragraph 1 provided that the lien is issued solely for the purpose of payment to the seller. In this case, the bank will be obliged to pay the whole purchase amount directly to the Međimurje County business account.
VII. Final provisions
The seller reserves the right to reject all bids or to cancel this invitation to bid without any justification.
The property shall be sold according to “bought on site principle”, therefore all subsequent objections will not be accepted.
